What is Expungement?
In New Jersey, an expungement will seal complaints, arrests, warrants, convictions, and arrest reports from the public.
Few people realize that a criminal arrest or conviction results in a permanent criminal history. Even if you are acquitted of the charges, records of your arrest will be accessible to the general public, including employers, insurance companies and landlords. For the rest of your life, every time you are asked if you were arrested for a crime on a job application or apartment lease, you will have to answer "yes."
Expungement seals your record and enables you to answer "no" if you are ever asked if you were arrested or convicted of a crime. However, some government agencies will still be able to access the information.
What Types of Crimes Can be Expunged?
Only first-time offenses for certain degrees of crimes can be expunged in New Jersey. For some offenses, you may have to wait six months to a year before your criminal records can be sealed.
Not all crimes can be expunged. For example, a drunk-driving arrest or conviction cannot be expunged.
