To enter into a civil union under New Jersey law:

  • The parties must be of the same sex and must generally be 18 years old or older — parties under age 16 must have consent of their parents and approved in writing by a judge of the Superior Court
  • Neither party can be involved in another civil union, domestic partnership or marriage

New Jersey is what is called a "no-fault" state with respect to matrimonial actions, and the same principles have been applied to Civil Unions with respect to dissolution and the division of jointly-owned property. Under New Jersey law, therefore, dissolution can be the result of:

  • Irreconcilable differences for more than six months
  • Adultery
  • Desertion or separation for 18 months or more
  • Extreme cruelty, whether physical or emotional
  • Institutionalization or imprisonment for a period of 24 months and 18 months, respectively
